“Shareware” is a method of software distribution that gives users an opportunity to try software before buying it. If you try a Shareware program and continue using it, you are expected to register. Details vary for individual programs: some request registration while others require it. Some specify a maximum trial period. With registration, you get anything from the simple right to continue using the software, to an updated program with printed manual.

In order to preserve and protect its rights under applicable law, Water’s Edge Software (the author and distributor) does not sell any rights in its SOFTWARE. Rather, Water’s Edge Software grants the right to use its SOFTWARE by means of a SOFTWARE LICENSE. Water’s Edge Software specifically retains title to all Water’s Edge Software products.
This is a special SHAREWARE Software License. It has restrictions that do not apply to registered Tools Plus users.

1. GRANT OF LICENSE. In consideration of your agreement to abide by the terms and conditions of this License and the Limited Warranty, Water’s Edge Software, as Licensor, grants you, the Licensee, a non-exclusive right to use and display this copy of Tools Plus and its related files (hereinafter the “SOFTWARE”) so long as you comply with the terms of this License. You are also granted a non-exclusive right to use and display the enclosed Tools Plus documentation (hereinafter the “DOCUMENTATION”). Water’s Edge Software reserves all rights not expressly granted to the LICENSEE.
2. OWNERSHIP OF SOFTWARE. As the LICENSEE, you own the magnetic disk or other physical media on which the SOFTWARE is originally or subsequently recorded or fixed, but an express condition of this License is that Water’s Edge Software retains title and ownership of the SOFTWARE and DOCUMENTATION, regardless of the form or media in or on which the original and other copies may exist. This License is not a sale of the original SOFTWARE or DOCUMENTATION, or any copy.
3. COPY and DISTRIBUTION RESTRICTIONS. This SOFTWARE and DOCUMENTATION are copyrighted, and are protected by United States and Canadian copyright laws and international treaty provisions. Unauthorized copying of SOFTWARE or DOCUMENTATION, including SOFTWARE that has been modified, merged, or included with other software, is expressly forbidden unless otherwise stated in this license. You may be held legally responsible for any copyright infringement that is caused or encouraged by your failure to abide by the terms of this License.
Tools Plus is a Shareware program and is provided at no charge to the user for the purpose of EVALUATION. You are encouraged to copy and distribute Tools Plus for non-commercial use with the restrictions listed below.
Please note that the self-extracting “Tools Plus 2.1 (C & Pascal)” file MAY have been renamed to comply with various networks’ and Bulletin Boards’ file naming conventions. Whenever you read the file name “Tools Plus 2.1 (C & Pascal)”, understand that it also refers to the file you have received, regardless of its actual name.
[i] You may copy and distribute the self-extracting “Tools Plus 2.1 (C & Pascal)” file but not the individual libraries, files and documents. This ensures that users receive a complete package with all documentation.
[ii] You may not modify the “Tools Plus 2.1 (C & Pascal)” file in any way.
[iii] You may not charge any fee for the use, copying, or distribution of the product. Clubs and user groups may charge a nominal fee (not more than $10 US) for expenses incurred while distributing Tools Plus. All other individuals and organizations must obtain written permission to distribute copies of Tools Plus if any fee is charged for the use, copying, or distribution of the product.
[iv] You may integrate the SOFTWARE product(s) (namely the files “ToolsPlus.Lib1”, “ToolsPlus.Lib2”, “ToolsPlus.p”, “ToolsPlus.c”, and “ToolsPlus.h”) with source code produced by you in your development of executable applications products using the SOFTWARE. You may also compile the SOFTWARE and imbed the resulting object code into executable applications products that you have developed.
[v] You may NOT distribute, commercially or otherwise, any product that includes the SOFTWARE, in whole or in part. This includes, but is not limited to, applications that you develop with the SOFTWARE. Distribution privileges are granted to REGISTERED users only.
[vi] Except as specifically provided above, you shall not copy, modify, transfer, license, sublicense, rent, lease, sell, convey, translate, adapt, convert to any programming language or format, reverse engineer, decompile or disassemble the SOFTWARE, or create derivative works based on the SOFTWARE, or any portion of the SOFTWARE.

4. USE RESTRICTIONS. This copy of Tools Plus is distributed as Shareware, and is for EVALUATION PURPOSES ONLY. You may use the SOFTWARE for thirty (30) consecutive days, starting from the day when you received the SOFTWARE. After the evaluation period (30 days), you must either:
[a] REGISTER the SOFTWARE, or
[b] permanently destroy the SOFTWARE and all copies, including any applications or entities that may have been created into which the SOFTWARE, in whole or in part, has been imbedded. If you decide not to register the SOFTWARE, you may not re-acquire the SOFTWARE for 1 year (365 days), regardless of the SOFTWARE version (otherwise, it would be possible to be perpetually “evaluating” the latest version of the SOFTWARE).

FURTHER, WATER’S EDGE SOFTWARE DOES NOT WARRANTY, GUARANTEE OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF USE, OF THE SOFTWARE OR WRITTEN MATERIALS IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. Neither Water’s Edge Software, nor anyone else who has been involved in the creation, production, or delivery of this product shall be liable for any direct, indirect, consequential or incidental damages (including damages for the loss of business profits, business interruption, loss of business information, and the like) arising out of the use or inability to use such product even if Water’s Edge Software has been advised of the possibility of such damages.
